These terms and conditions regulate the legal relationship between Fancy Sailing and Clients. The terms define the responsibilities of:

  • Charter Broker/Agent: Fancy Sailing (fancysailing.com)
  • Charter Company: The yacht owner or management company
  • Client: The lead charterer who signs the Charter Agreement and accepts these terms

1. Services by the Charter Broker/Agent

  1. Acts as intermediary between Charter Companies and Clients
  2. Signs agreements and collects payments on behalf of Charter Companies
  3. Assesses Client preferences via email, phone, or messaging apps
  4. Considers service level, cuisine, and port availability
  5. Proposes suitable yachts based on requirements
  6. Provides fee quote and sends Charter Agreement if accepted
  7. Issues invoice and confirms booking upon payment
  8. Handles logistics until embarkation (e.g. provisions, transfers)
  9. After embarkation, yacht operation is managed by the yacht’s base team or crew

2. Representations to the Client

  1. All yacht information is shared in good faith
  2. Efforts are made to ensure accuracy
  3. No guarantees on yacht condition beyond what the Charter Company provides
  4. No liability for issues once the Client boards the yacht
  5. Photos may differ from the actual yacht

3. Client Commitments

  1. Client agrees to comply with the Charter Agreement
  2. These terms do not alter Charter Agreement obligations
  3. Client is fully responsible for the yacht upon embarkation
  4. Client liable for damages caused by them or their guests
  5. Client accepts the yacht as inspected and in good condition
  6. Yacht must be used in compliance with applicable laws

4. Booking Confirmation

  1. Client signs Charter Agreement and pays prepayment invoice
  2. Booking is valid upon receipt of both payment and signed agreement
  3. Availability and price are not guaranteed until confirmed

5. Booking Amendments

  1. Broker will try to accommodate changes at no extra cost
  2. Changes are subject to yacht availability
  3. If not possible, original terms remain in force

6. Payment Terms

  1. 50% due at booking
  2. Remaining 50% due six (6) weeks prior to embarkation
  3. Late payments may result in cancellation
  4. If booked within 6 weeks of embarkation, full payment is due

7. Payments and Charges

  1. Payments accepted via bank transfer or credit/debit cards (Visa, MasterCard, Amex)

8. Security Deposit

  1. Client provides a deposit/pre-authorization to cover potential damages
  2. Returned after check-out inspection confirms no damage

9. Pricing and Fees

  1. Additional fees may apply due to government taxes or costs

10. Cancellation Policy

  1. More than 60 days: 30% cancellation fee
  2. 30–60 days: 50% cancellation fee
  3. Less than 30 days: 100% cancellation fee
  4. If yacht is rebooked, only €300 dossier fee applies

11. Insurance

  1. Client is advised to obtain trip and damage insurance

12. Broker Liability

  1. No liability after embarkation
  2. Broker is only liable for its own negligence
  3. Not liable for actions of third parties or force majeure

13. Client Documentation

  1. Client must provide accurate ID and sailing certificates
  2. Broker accepts documents in good faith
  3. Client is responsible for document validity

14. Reservation & Substitution

  1. Charter Company may cancel due to yacht damage or other issues
  2. Broker may offer alternatives in good faith

15. Complaints

  1. Complaints should first be addressed to yacht staff
  2. If unresolved, written complaint must be filed within 30 days
  3. Disputes are between Client and Charter Company

16. Crew Terms & Cancellations

  1. See separate crew terms and cancellation policy

17. Liability Limit

  1. Broker’s liability limited to commission earned on that charter

18. Governing Law

  1. These terms are governed by the laws of Greece
  2. Jurisdiction lies with courts in Athens, Greece

The Client acknowledges and agrees to all terms above by proceeding with the booking.
